Psilocybin-Containing Species

Species such as Psilocybe cubensis contain psilocybin and psilocin, which are classified as Schedule I controlled substances under the United States Controlled Substances Act and are similarly restricted in many other countries. The legal status of these substances varies significantly:

  • Federal law (US): Psilocybin is a Schedule I substance. Cultivation, possession, and distribution of psilocybin-containing mushrooms is a federal offense.
  • State & local laws: Some jurisdictions (e.g., Oregon, Colorado, and certain municipalities) have enacted decriminalization measures or regulated therapeutic use frameworks. These vary in scope and do not override federal law.
  • International: Laws differ widely by country. Some nations permit research use, some have decriminalized personal possession, and many maintain strict prohibitions. Always verify the laws specific to your location.
  • Spore legality: In some US jurisdictions, psilocybin mushroom spores may be legal to possess for microscopy purposes since spores do not contain psilocybin. However, cultivating spores into mycelium or fruiting bodies is illegal where psilocybin is prohibited. This distinction varies by jurisdiction.
